Respect for Intellectual Property

At PastelGlobal, we are committed to respecting the intellectual property rights of others, and we expect our users to do the same. Our platform is a place for creativity and expression within the bounds of law and respect for the creations of others.

Reporting Alleged Infringement

If you believe that your intellectual property rights have been violated in any way through our services, we encourage you to inform us by providing a detailed account of the alleged infringement. Your notification should include the following information:

  1. A physical or electronic signature of the person authorized to act on behalf of the owner of the IP right that is allegedly infringed.
  2. A description of the IP that you claim has been infringed upon, including any relevant registration numbers or a detailed description of the intellectual property if not registered.
  3. A detailed description of where the material that you claim is infringing is located on our site (URLs or other identifying information).
  4. Your address, telephone number, and email address so that we can contact you.
  5. A statement by you that you have a good faith belief that the disputed use is not authorized by the IP owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the IP owner or authorized to act on the IP owner’s behalf.

How We Handle Claims

Upon receiving a proper claim of intellectual property infringement, PastelGlobal will take the following steps:

  1. Review the claim to determine its validity.
  2. Temporarily remove or disable access to the material claimed to be infringing.
  3. Notify the provider of the material, giving them an opportunity to respond to the claim.

Counter-Notification

If the provider of the disputed content believes that the removal or disabling of the material was a mistake or that they have the right to use the material, they may send us a counter-notification with evidence supporting their claim. This counter-notification should include the following:

  1. The provider’s physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that the provider has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. The provider’s name, address, and telephone number, and a statement that the provider consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if the provider’s address is outside of the United States, for any judicial district in which PastelGlobal may be found, and that the provider will accept service of process from the person who provided notification of the alleged infringement.

Our aim is to ensure that the rights of all parties are respected and upheld in accordance with the law.
